MYSH-Jewelry Terms of Service
These Terms of Service (the "Terms") govern your access to and use of the MYSH-Jewelry website (the "Website"), purchase of our men's jewelry products (including necklaces, pendants, bracelets, rings, earrings, brooches), and use of our related services (collectively, the "Services").
MYSH-Jewelry ("we", "us", or "our") is a U.S.-based independent online store. By accessing or using our Services, you ("you", "your") acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and all applicable U.S. laws and regulations. If you do not agree to these Terms, please do not use our Services.
Our physical warehouse is located in China, solely for product storage and order fulfillment. All transactions, customer service, and data processing related to the Services are conducted in the United States in compliance with U.S. laws. These Terms constitute a legally binding agreement between you and MYSH-Jewelry.
1. Eligibility and Use of Services
To use our Services, you must be at least 18 years old or have the legal capacity to enter into a binding contract under U.S. law. You agree to use our Services only for lawful purposes and in accordance with these Terms. Prohibited uses include, but are not limited to:
- Using the Website to engage in fraud, misrepresentation, or illegal activities
- Infringing on MYSH-Jewelry's intellectual property rights or the rights of third parties
- Uploading or transmitting viruses, malware, or other harmful content to the Website
- Attempting to gain unauthorized access to the Website's backend systems or customer data

2. Orders and Payment
2.1 Order Placement and Confirmation
When you place an order on the Website, you submit a binding offer to purchase the selected MYSH-Jewelry products. We reserve the right to accept or reject your order for any reason, including but not limited to product unavailability, pricing errors, or suspected fraud.
You will receive an email confirmation once your order is accepted and processed. The order confirmation constitutes a valid contract between you and MYSH-Jewelry.
You agree to provide accurate, complete, and up-to-date contact and shipping information when placing an order. We are not liable for delays or delivery failures caused by incorrect information provided by you.
2.2 Pricing and Payment
All prices displayed on the Website are in U.S. Dollars (USD) and include applicable taxes (where required by U.S. state law). We reserve the right to adjust prices at any time without prior notice, but such adjustments will not affect orders already confirmed.
Payment must be made in full at the time of order placement. We accept payments through third-party payment processors (e.g., PayPal, credit cards) that comply with the Payment Card Industry Data Security Standard (PCI DSS).
We do not store your full payment card details; all payment processing is handled securely by our payment partners. You agree to provide valid payment information and authorize us to charge the total order amount (including shipping fees) to your selected payment method.
3. Customized Products
For customized MYSH-Jewelry products (e.g., engraved rings, personalized necklaces, custom-sized bracelets), the following additional terms apply:
- You must provide clear, accurate customization requirements (e.g., names, initials, dates, design preferences) at the time of order.
- We will send you a Customization Confirmation via email, outlining the design details, production timeline, and any applicable additional fees.
- Production will begin only after you confirm the details in writing.
Customized products are non-refundable and non-exchangeable, except for defects or damages caused by our production errors.
If you wish to cancel a customized order after production has started, you will be subject to a cancellation fee (not exceeding 50% of the product price in accordance with industry practices).
Minor variations (e.g., slight differences in engraving depth, color nuances of materials) may occur and are not considered defects. We will provide photos/videos of the finished product for your confirmation before shipment, if requested.
4. Shipping and Delivery
We ship products from our China warehouse to your designated U.S. or international address via authorized international logistics providers (e.g., DHL, FedEx). Shipping fees and estimated delivery times are displayed at checkout.
Delivery times are estimates only and may be delayed due to customs clearance, weather conditions, or other unforeseen circumstances. We are not liable for indirect damages caused by delivery delays.
You are responsible for any customs duties, taxes, or fees imposed by your country/region for international shipments. We do not collect these fees in advance and are not responsible for informing you of their exact amounts.
Once the shipment is handed over to the logistics provider, the risk of loss or damage to the products passes to you. We recommend purchasing shipping insurance at checkout for high-value items.
5. Returns and Refunds
Our return policy is incorporated into these Terms.
For non-customized products, you may request a return within
30 calendar days of receiving the item, subject to the following conditions:
- The item must be in its original, unused condition, with all MYSH-Jewelry tags attached and in the original packaging
- You must contact our customer service at info@myshjewelry.com to obtain return approval before shipping the item back
- Unsolicited returns will not be accepted
- You are responsible for all return shipping costs. We recommend using a trackable shipping method and insuring the package
Refunds will be processed to your original payment method within 5–7 business days after we receive and inspect the returned item. Please allow up to 14 business days for the refund to reflect in your account, depending on your bank or payment provider.
The following are non-returnable (except for defects or damages caused by our production errors):
- Customized products
- Sale/clearance items
- Gift cards
6. Intellectual Property Rights
All intellectual property rights related to MYSH-Jewelry products, the Website, and our Services (including but not limited to trademarks, logos, product designs, text, images, and software) are owned by or licensed to MYSH-Jewelry.
You may not reproduce, distribute, modify, or use these intellectual property rights without our prior written permission.
You retain ownership of any customization content (e.g., names, initials) you provide, but grant us a non-exclusive, royalty-free license to use such content to produce and deliver the customized product.
7. Limitation of Liability
To the maximum extent permitted by U.S. law, MYSH-Jewelry shall not be liable for any indirect, incidental, special, or consequential damages (including but not limited to loss of profits, loss of data, or reputational damage) arising out of or in connection with your use of our Services or purchase of our products.
Our total liability for any claim arising under these Terms shall not exceed the total amount paid by you for the specific product or service giving rise to the claim.
This limitation of liability does not apply to damages caused by our gross negligence, willful misconduct, or failure to comply with applicable U.S. laws.
8. Indemnification
You agree to indemnify, defend, and hold harmless MYSH-Jewelry, its officers, employees, and partners from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising out of:

9. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

- Port strikes, customs delays
- Government regulations
- Technical failures of third-party services
We will notify you of such circumstances and make reasonable efforts to resume performance as soon as possible.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.
Any dispute shall first be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to arbitration in New York City in accordance with the rules of the American Arbitration Association (AAA). The arbitration award shall be final and binding.
Alternatively, either party may file a claim in the state or federal courts located in New York City, New York, and both parties consent to the jurisdiction of such courts.
11. Modifications to These Terms
We may update these Terms from time to time to reflect changes in U.S. laws, our business practices, or the Services.
The updated Terms will be posted on the Website with a revised "Last Updated" date. Your continued use of the Services after the update takes effect constitutes your acceptance of the revised Terms.
12. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MYSH-Jewelry regarding the Services.
If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
